Why Mediate? Benefits of Mediation
Mediation is a voluntary process where parties engage a Mediator who assists the parties to resolve their dispute in a timely manner avoiding long delays through the Court process
Mediation is an efficient and inexpensive way of resolving disputes
Mediation is completely confidential
Mediation saves time. Skilled Mediators can focus the parties on the real issues unblocking obstacles that prevent a matter being resolved
Mediation is flexible. With the assistance of the Mediator the parties customise the process to meet their needs
Mediation is informal, relaxed and less stressful than being involved in the court process
Mediation allows the parties to control the outcome unlike the Court process where a decision is imposed
Mediation where successful preserves the parties’ relationship
Mediation Process
Parties participate in a pre- mediation conference to identify the issues in dispute and assess the parties’ suitability for Mediation. During the conference safety issues and the parties preferred approach to Mediation is discussed. Issues in dispute are identified and preparation for Mediation (in the form of evidence) is discussed. The pre-mediation conference is conducted remotely with the parties and/or their lawyers.
Where the Mediation process is deemed suitable and agreed upon, a timetable and preferred venue is set at the convenience of the parties and/or their lawyers.
Mediation may be set for half a day or a full day depending on the complexity of the issues in dispute. The Mediation process can be conducted remotely or in person with safety arrangements a priority where one or other party is unable to participate face to face. Microsoft Teams or Zoom is available for remote Mediation.
The Mediator facilitates the parties through the Mediation process to best assist the parties to reach a final resolution to the dispute.
